1. Acceptance of Terms

Welcome to WaveX Connect Pvt Ltd ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website (wavexconnect.com), mobile platforms, customer portals, telecom infrastructure offerings, FTTH broadband connections, and field technician booking services.

By creating an account, placing a service booking, subscribing to a internet plan, or accessing any part of our services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease using our platform and services.

2. Description of Services

WaveX Connect Pvt Ltd is a specialized telecommunications infrastructure and IT deployment company operating across India. Our services include, but are not limited to:

• FTTH & Broadband Deployment: Fiber-to-the-Home broadband line installation, ONT/Router provisioning, and network integration (including partnership setups with enterprise carriers such as BSNL).
• Telecom Infrastructure & EPC Services: Optical fiber cable laying, tower erection, network cabling setup, and project management.
• Technician Booking Platform: On-demand booking of certified field engineers for site surveys, fiber splicing, line maintenance, network troubleshooting, and hardware installation.
• Digital Portals: Customer management portal for plan renewals, report generation, service ticket tracking, and complaint resolution.

3. User Eligibility & Account Registration

To use our services or register an account, you must meet the following conditions:

• Age Requirement: You must be at least 18 years of age or possess legal authority under Indian law to enter into binding legal agreements.
• Accurate Registration: You agree to provide true, accurate, current, and complete information during registration and keep your account details updated.
• Mandatory KYC: Telecom line provisioning requires submission of valid government-issued Know Your Customer (KYC) identity and address proof documents as mandated by the Department of Telecommunications (DoT) India.
• Account Security: You are solely responsible for maintaining the confidentiality of your account password and login credentials. You are responsible for all activities occurring under your account.

4. Subscriber Obligations & Acceptable Use

You agree to use our network infrastructure, broadband connections, and website only for lawful purposes. You explicitly agree NOT to:

• Use the service for any illegal, unauthorized, fraudulent, or malicious activities violating Indian laws, including the Information Technology Act, 2000.
• Resell, redistribute, or share your residential broadband connection for commercial ISP operations without explicit written authorization from WaveX Connect Pvt Ltd.
• Attempt to gain unauthorized access to our servers, network hardware, subscriber databases, or bypass network security controls.
• Distribute computer viruses, malware, spam, or engage in Distributed Denial of Service (DDoS) attacks using our network infrastructure.
• Interfere with or damage physical cabling, optical distribution boxes, ONTs, or telecom equipment installed at your premise or public rights-of-way.

5. Service Bookings & Feasibility Checks

When you place an online booking for technician installation or broadband deployment:

• Location Feasibility: Installation of FTTH and high-speed broadband lines is subject to physical fiber feasibility, optical splitter port availability, and right-of-way permissions at your installation address.
• Technician Visits: Scheduled technician site visits require an adult representative present at the site. Access to building risers, utility rooms, or premises must be granted to the field engineer.
• Rescheduling & Cancellation: Appointments may be rescheduled or cancelled through the customer portal up to 2 hours prior to the scheduled slot without incurring penalties.

6. Billing, Fees & Payment Terms

• Pricing Structure: Prices for broadband plans, hardware (ONT/Routers), installation charges, and technician visit fees are clearly specified on our website. All prices are listed in Indian Rupees (INR) and are subject to applicable GST taxes.
• Payment Collection: Payments must be made via authorized electronic channels (Debit/Credit Cards, UPI, Net Banking, or approved wallets).
• Advance Subscription: Prepaid broadband plans must be renewed prior to the expiry date to ensure uninterrupted connectivity.
• Refunds & Cancellations: Installation fees or subscription charges once paid are refundable only if site feasibility fails prior to installation setup. Refund claims are processed within 7-10 business days back to the original source payment account.

7. Service Suspension & Termination

WaveX Connect Pvt Ltd reserves the right to suspend, restrict, or terminate your access to services, accounts, or broadband lines immediately without prior notice if:

• You breach any provision of these Terms or fail to rectify a non-payment situation within the grace period.
• Your KYC documentation is found to be forged, incomplete, or invalid upon verification.
• Directed to do so by any court, regulatory body (TRAI), or law enforcement authority.
• Your network usage poses a threat to network security, physical infrastructure, or other subscribers.

8. Service Availability & SLA

While WaveX Connect Pvt Ltd strives to maintain high service availability and network uptime (99.5% target for standard fiber connections):

• Services may be temporarily interrupted due to scheduled maintenance, emergency repairs, physical fiber cuts by third-party road contractors, or utility disruptions.
• Force Majeure: We are not liable for service failures or delays caused by events beyond our reasonable control, including natural disasters, extreme weather, civil disturbances, power grid failures, or government restrictions.

9. Intellectual Property Rights

All intellectual property on our website and digital portals—including company names, logos, design code, text, graphics, service marks, and proprietary software—are owned by or licensed to WaveX Connect Pvt Ltd. You are granted a limited, non-exclusive, non-transferable license to access the website for personal, non-commercial use only.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• WaveX Connect Pvt Ltd, its directors, employees, or contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data loss, or business interruption) resulting from your use or inability to use our services.
• Our total aggregate liability for any direct claims arising out of these Terms or service delivery shall be strictly capped at the total fee paid by you to WaveX Connect Pvt Ltd in the one (1) month preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless WaveX Connect Pvt Ltd, its officers, employees, technicians, and partners against any claims, liabilities, damages, losses, costs, or legal fees arising from your breach of these Terms, unauthorized use of our network, or violation of any third-party rights.

12. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any legal action, dispute, or proceeding arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in India.
